Hojumoni Terms of Service
Rules for using Hojumoni community, marketplace, event, job, messaging, payment, and moderation features.
1. Acceptance And Eligibility
By accessing or using Hojumoni, you agree to these Terms and our Privacy Policy. You must be at least 13. If you are under 18, you must have a parent or guardian's permission where required, and you may not use features or enter transactions that you cannot legally use or enter.
2. Accounts
- Provide accurate information and keep it current.
- Protect your credentials and tell us promptly about unauthorised access.
- Do not create deceptive accounts, evade restrictions, or impersonate another person or business.
- You are responsible for activity carried out through your account unless applicable law provides otherwise.
3. Hojumoni's Role
Hojumoni provides technology for members to communicate, publish content, discover local information, arrange events, advertise jobs, and connect with buyers, sellers, employers, applicants, and organisers. Unless Hojumoni expressly identifies itself as the provider of an item or service, Hojumoni is not the seller, landlord, employer, agent, broker, or party to a member-to-member transaction.
Users decide whether to transact and are responsible for checking identity, suitability, legality, licences, condition, price, payment instructions, and safety.
4. User Content
You retain ownership of content you submit. You grant Hojumoni a worldwide, non-exclusive, royalty-free licence to host, copy, process, display, distribute, and adapt that content only as reasonably needed to operate, secure, moderate, promote, and improve the service. You confirm that you have the rights and permissions needed to submit the content.
Public content may be indexed by search engines and shared outside Hojumoni. Deleting content or your account removes it from active Hojumoni surfaces, subject to legal retention, safety evidence, backups, and content already shared by others.
5. Groups, Messaging, And Moderation
Group leaders and authorised moderators may manage membership and content within their scope. Hojumoni may filter submissions, review reports, remove or restrict content, close conversations, hide groups or listings, limit features, suspend accounts, or terminate access to protect members, comply with law, or enforce these Terms.
Use report and block tools for abuse. Do not use Hojumoni for emergencies; contact emergency services where someone faces immediate danger.
6. Marketplace, Housing, And Services
- Listings must be truthful, current, appropriately categorised, and lawful.
- Sellers and service providers must have the right to offer the item or service and comply with applicable licences, safety rules, taxes, tenancy, employment, and consumer laws.
- Buyers should inspect goods and verify material information before paying or meeting.
- Housing content must comply with tenancy, occupancy, anti-discrimination, safety, and advertising laws.
- Hojumoni does not guarantee availability, quality, identity, legal compliance, or completion of a member transaction.
7. Events And Payments
Payment features facilitate participation in physical events, goods, or services delivered outside the app. Stripe may process card payments and connected-account payouts under its own terms. Organisers are responsible for accurate prices, capacity, dates, cancellation terms, delivery, refunds, tax obligations, and lawful use of payment details.
Any Hojumoni fee will be shown before payment. Refunds and cancellations are governed by the organiser's disclosed terms and applicable law. We may pause payouts, close checkout sessions, preserve transaction records, or assist providers and authorities with refunds, disputes, fraud, or chargebacks. Do not use app payments to sell digital content or digital features consumed in Hojumoni.
8. Jobs And Applications
Hojumoni is not an employment agency and does not guarantee a job, applicant, work entitlement, wage, condition, or employer. Employers must comply with workplace, award, minimum-wage, superannuation, safety, privacy, and anti-discrimination obligations. Applicants must provide accurate application information and independently verify roles and employers before sharing additional information or commencing work.
9. Business Verification And Reputation
ABN or business verification means only that selected details matched available records or passed the stated review. It is not an endorsement, licence check, solvency check, identity guarantee, or guarantee of goods, work, conduct, or payment. Ratings, reviews, contribution levels, and badges are community signals and may be incomplete.
10. Prohibited Content And Conduct
- Harassment, threats, hate, sexual exploitation, child endangerment, doxxing, stalking, or non-consensual intimate content.
- Fraud, scams, deceptive payment requests, spam, artificial engagement, or attempts to bypass safety controls.
- Stolen, counterfeit, recalled, unsafe, illegal, or regulated goods offered without required authority, including illegal drugs, prohibited weapons, and unlawful sexual services.
- Discriminatory housing or employment advertising, unlawful work arrangements, or exploitation.
- Malware, scraping, unauthorised access, reverse engineering where prohibited, or interference with the service.
- Content that infringes privacy, copyright, trade marks, confidentiality, or other rights.
11. Intellectual Property
Hojumoni's software, branding, design, and non-user content are owned by Hojumoni or its licensors. Third-party source material remains subject to the source owner's rights and any displayed attribution or licence.
12. Availability, Disclaimers, And Consumer Rights
We work to provide a reliable service but do not promise uninterrupted availability or that every user, listing, message, verification, map result, or third-party service is accurate or safe. To the extent permitted by law, Hojumoni is provided on an "as is" and "as available" basis.
Nothing in these Terms excludes, restricts, or modifies a consumer guarantee, right, remedy, or liability that cannot lawfully be excluded, including under the Australian Consumer Law.
13. Liability
Subject to non-excludable rights, Hojumoni is not liable for indirect or consequential loss, lost profits, loss of opportunity, member conduct, or a member-to-member transaction. Where liability can lawfully be limited, it is limited to the extent permitted by applicable law.
14. Suspension, Deletion, And Changes
You may stop using Hojumoni and delete your account in Settings. We may suspend or terminate access for serious or repeated breaches, legal requirements, safety risks, or service protection. We may update these Terms and will provide appropriate notice of material changes.
15. Applicable Law And Contact
These Terms are governed by applicable Australian law. Mandatory rights in your state, territory, or country continue to apply.
